RE: The tariff classification of a "Bath Organizer" from China.

Dear Mr. Lawless:

In your letter dated March 30th, 2000 you requested a tariff classification ruling.

The sample submitted with your request is identified as a "bath organizer". The item is a travel case that can be used to store bath products or other merchandise. The article has an exterior surface of a fabric backed sheeting of Polyvinyl Chloride (PVC) and measures approximately 10 1/2" x 9 3/4" x 2". The case is secured by a zip-around closure and has a top carry handle. A zippered pocket of clear PVC is located on the front of the bag. The interior of the front of the case has a zippered pocket, an open mesh pocket, and a metal hanger head attached to a self-strip that is sewn into the top interior. The bottom compartment has an elasticized loop holder that is separated into three sections. Below the elasticized loop holder are three open pouches of nylon mesh.

The applicable subheading for the "Bath Organizer" will be 4202.92.4500, Harmonized Tariff schedule of the United States (HTS), which provides for travel, sports, and similar bagsā€¦other. The rate of duty will be 20% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
